Definition

A Widerspruchsbescheid is the formal written decision of a German authority on a Widerspruch (formal objection) you filed against an earlier Bescheid. It can fully grant your objection, partially grant it, or reject it entirely. If the decision rejects or only partially grants your objection, it triggers a one-month window to file a Klage (lawsuit) at the competent court.

Who sends it

The same authority that issued the original Bescheid — or its superior authority (Widerspruchsbehörde). The letter references your original Bescheid and your Widerspruch by date and Aktenzeichen.

What it’s asking for

No action if the objection was fully granted. If rejected, you must decide within one month whether to file a Klage at court. The Rechtsbehelfsbelehrung at the end of the letter states exactly which court, under which deadline, and under which procedural rule.

Your deadline

One month from receipt to file a Klage (§ 74 VwGO for administrative courts; § 87 SGG for social courts). This is a hard deadline; missing it makes the decision final (bestandskräftig).

Typical next steps

  1. Read the operative part (Tenor) — the first section states the decision: granted, partially granted, or rejected.
  2. Find the Rechtsbehelfsbelehrung at the end — it tells you which court, what deadline, and what procedural law applies.
  3. If you disagree with the decision, consult a lawyer (Rechtsanwalt) immediately — the one-month window is strict.
  4. If the objection was granted, check that the authority has corrected the original Bescheid.
  5. Keep both the original Bescheid and the Widerspruchsbescheid — you'll need them for any Klage.

Stated consequences under German law

If you do not file a Klage within one month, the Widerspruchsbescheid becomes legally final (bestandskräftig und vollziehbar). It can then be enforced and cannot be challenged further except in extraordinary circumstances.

Frequently asked questions

My Widerspruch was rejected. What are my options?

You can file a Klage at the competent court within one month of receiving the Widerspruchsbescheid. The Rechtsbehelfsbelehrung states which court. For tax matters: Finanzgericht. For residence matters: Verwaltungsgericht. For Jobcenter or BA: Sozialgericht.

Does filing a Klage suspend enforcement?

For many types of Bescheid, filing a Klage does not automatically suspend enforcement. You must separately apply for vorläufigen Rechtsschutz (interim relief) at the court if you want to stop enforcement while your case is pending.

What is the Rechtsbehelfsbelehrung?

The Rechtsbehelfsbelehrung is the mandatory legal remedies notice at the end of every German administrative decision. It states which legal challenge is available, which court handles it, and the exact deadline. If this notice is missing or incorrect, your deadline to challenge may be extended to one year.

How does Aplet help with a Widerspruchsbescheid?

Aplet identifies whether the objection was granted or rejected, extracts the stated deadline for Klage, and explains the Rechtsbehelfsbelehrung in plain English. For rejected objections above a few hundred euros, many people also consult a lawyer; Aplet's summary can make that conversation faster.

What if I never filed a Widerspruch but received this letter?

That is unusual. Check whether a family member, a lawyer, or a representative filed on your behalf. If the letter is addressed to you but relates to a matter you do not recognise, contact the issuing authority immediately using the Aktenzeichen shown on the letter.
